These terms govern the sale by OuiLovePerhentian of snorkelling trips and trip-planning services in the Perhentian Islands to any adult who books through this site, WhatsApp or email. Booking means accepting these terms. The version that applies is the one in force on the date of your booking.
Five day trips, described on the home page, departing from Kampung Nelayan on Perhentian Kecil. On request we also arrange full stays combining transfers, accommodation and trips.
Trips are operated by partner local crews who handle navigation and guiding at sea. Our role is organisation, information and follow-up.
Included: your place on board, snorkelling gear (mask, snorkel, vest) and the crew's guidance.
Not included: lunch and drinks, the marine park fee payable locally to the Malaysian authorities, personal insurance, travel to the islands unless stated, and personal expenses.
A booking is confirmed once payment is received in full and we have confirmed in writing, by email or WhatsApp. Places are limited by boat capacity and allocated in order of booking.
The Redang excursion must be booked no later than the day before departure. Some trips require a minimum number of participants; we tell you before you pay.
Prices are in euros, per person, and exclude local taxes payable on site. Payment is made online, in one instalment, by card or Apple Pay, processed by Stripe Payments Europe Ltd. We never have access to your card details. No deposit: the full amount is paid at booking.
Under Article L. 221-28, 12° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to leisure services supplied on a specific date or during a specific period. Our trips fall into that category, so the cancellation terms in Article 6 apply instead.
Cancellations must reach us in writing, by email or WhatsApp. The date of receipt applies.
Refunds are made to the original payment method within fourteen days.
Safety comes before the programme. We may change the route, postpone or cancel a trip in the event of adverse weather or sea conditions, a decision by the port authorities, closure of a marine park site, technical failure or force majeure.
In that case we offer an alternative date or, if none suits you, a full refund. No further compensation may be claimed. A minor change to the order or choice of snorkelling sites, made because of conditions on the day, is not a cancellation.
You agree to follow the crew's safety instructions, to arrive on time at the meeting point, and to tell us before booking of anything that might affect your participation.
Trips suit beginners, but they take place in open water and a basic level of comfort in the sea is required. Minors must be accompanied by a responsible adult, who remains responsible for them throughout.
The marine park is a protected area: do not touch the coral, do not feed or chase wildlife, and leave no waste behind. We recommend sunscreen free of oxybenzone and octinoxate.
We are responsible for the proper performance of the services we sell, within the limits set by applicable law. We are not liable where the fault lies with you, with an unforeseeable and unavoidable act of a third party unconnected with the service, or with force majeure. We are not responsible for loss, theft or damage to personal belongings taken on board.
We strongly recommend taking out travel insurance covering cancellation, medical expenses, assistance and repatriation. No such insurance is included in our services.
Complaints should be sent to ouiloveperhentian@gmail.com, ideally within thirty days of the trip. We reply within fifteen days. Failing an amicable solution, consumers resident in the European Union may use a consumer mediation scheme free of charge. [MEDIATOR DETAILS TO BE ADDED]
These terms are governed by [GOVERNING LAW TO BE DETERMINED]. Mandatory consumer protection rules of your country of habitual residence continue to apply under Regulation (EC) No 593/2008. A consumer resident in the European Union may bring proceedings before the courts of their place of residence.

We never ask for health data. If you volunteer a medical restriction, we keep it only for as long as the trip concerned requires.
We send no newsletter and run no automated marketing. No automated decision-making or profiling is applied to your data.
Your data is never sold, rented or exchanged. It is accessible to the OuiLovePerhentian team and to the following providers, each strictly within its role:
Two transfers leave the European Union. We run the agency from Malaysia, a country without an adequacy decision: the transfer is necessary to perform the contract you enter into with us, under Article 49(1)(b) GDPR. Some providers are established in the United States and frame those transfers using the European Commission's standard contractual clauses or their certification under the EU–US Data Privacy Framework.
You have the right of access, rectification, erasure, restriction, objection and portability. To exercise them, write to ouiloveperhentian@gmail.com. We reply within one month. If you believe your rights are not respected, you may lodge a complaint with the supervisory authority of your country of residence — in France, the CNIL, cnil.fr.
This site sets no advertising cookies and uses no analytics, so no consent banner is required. Two external services do load with the page and therefore receive your IP address: the Google Maps embed, which may set its own cookies, and Google Fonts. You can block Google's domains in your browser if you prefer; the map will stop displaying but the rest of the site will work normally.
The site is served over HTTPS. Payments are handled by a PCI-DSS certified provider. Access to our tools is protected by separate passwords and two-factor authentication wherever available.
